1. General provisions.
1.1. These terms and conditions for the purchase and sale of goods (products) (hereinafter - Terms) are a binding legal document for the Parties, which determine the Buyer's and Seller's LLC "Recito", company code 305208905, registered office address Taikos pr. 141, LT-51132 Kaunas, VAT payer code LT100012511712 (hereinafter - the Seller) rights, duties and responsibilities when Buyer purchase goods from online store www.domusinn.com (hereinafter - e-shop).
1.2. By placing an order, the Buyer confirms that he agrees with these Terms.
1.3.The Seller have the right to change or supplement the Terms at any time. When the Buyer is shopping in the e-shop applies the Terms valid at the time of placing the order.
1.4.The contract between the Buyer and the Seller is considered concluded when the Buyer forms and submits in the e-shop the order of goods, makes payment and the Seller sends a confirmation that the Buyer's order has been accepted to the e-mail specified by the Buyer.
2. Protection of personal data.
2.1. The Buyer can order the goods in the e-shop by these ways:
- By registering in the e-shop – by entering requesting personal data during registration process;
- Without registering in the e-shop.
2.2. When ordering goods, the Buyer must specify the personal data of the Buyer necessary for the proper fulfilment of the contract, in the relevant information fields provided by the Seller: name, surname, delivery address of the goods, postal code, telephone number and e-mail address, also specify other information (if the Seller indicates that the relevant information is required when placing the order).
2.3. The Buyer is responsible that personal data provided are correct.
2.4. By placing an order, the Buyer agrees that the personal data provided by him will be processed for the purposes specified in the Privacy Policy (which is published at https://domusinn.com/lt/content/8-privatumo-politika).
2.5. The Buyer's personal data will be processed for direct marketing purposes only after receiving the Buyer's consent. The Buyer's consent is expressed by registering in e-shop and by checking the relevant fields for receiving offers, as well as in other legal ways.
2.6. The personal data provided by the Buyer will be processed in accordance with these Terms, the Privacy Policy (which is published at https://domusinn.com/lt/content/8-privatumo-politika), Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), the Law on the Legal Protection of Personal Data of the Republic of Lithuania and other legal acts regulating the processing of personal data.
3. Buyer's rights and obligations.
3.1. The Buyer has the right to withdraw from the contract of purchase and sale of the goods as indicated in the point 8.1 of these Terms.
3.2. The Buyer undertakes to accept the ordered goods and to pay the price for them according to the order information, in compliance with this Terms.
3.3. The Buyer must immediately update the changed data of the Buyer, which was provided in the registration form. If the Buyer provides inaccurate, false or misleading data, the Seller has the right to cancel the Buyer's registration and delete the data.
3.4. The Buyer undertakes not to transfer his login data to third parties. If the Buyer loses his login data, he must immediately inform the Seller about this in writing, using the means of communication indicated in the "contact us" section.
4. Seller's rights and obligations.
4.1. The Seller undertakes to create all the conditions for the proper use of e-shop by the Buyers.
4.2. If the Buyer tries to harm the stability and/or security of the e-shop work or violates its obligations, the Seller has the right to limit, suspend or cancel the Buyer's ability to use e-shop without warning.
4.3. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
4.4. The Seller reserves the right at any time, without notifying the Buyer, to terminate the provision of services, change e-shop or its individual parts, all and any of its contents.
5. Product prices, payment procedure.
5.1. The prices of the goods in the e-shop are indicated in euros, including the amount of VAT in force at the time according to the legislation and other taxes, if such are applicable.
5.2. The Buyer pays for the goods in one of the following ways:
- internet banking;
- credit or debit card;
- other ways indicated on the www.domusinn.com website.
6. Delivery of goods.
6.1. When ordering goods, the Buyer can choose one of the methods of delivery, which is indicated in the offer of the specific goods:
- delivery of goods to the address specified by the Buyer;
- delivery of the goods to the pickup shops.
6.2. If the Buyer chooses the service of delivery of goods to the specified address, the Buyer undertakes to indicate the exact place of delivery of the goods. The Buyer undertakes to accept the goods himself. When accepting goods, it is necessary to present a valid document confirming personal identity (identity card or passport). In the event that the Buyer cannot accept the goods himself, and the goods are delivered to the specified address, the Buyer has no right to make claims to the Seller regarding the delivery of the goods to the wrong subject.
6.3. The fee for delivery service is indicated in the e-shop website and applicable at the time of placing the order. The delivery fee can be both fixed or dependent on the value of the goods ordered by the Buyer.
6.4.The Seller delivers the goods to the Buyer in the terms specified in the e-shop. These terms are preliminary and do not apply in cases where the Seller does not have the required goods in stock and the Buyer is informed of the shortage of the ordered goods. At the same time, the Buyer agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In this case, the Seller undertakes immediately contact the Buyer and agree on the terms of delivery of the goods.
6.5. The Seller is released from responsibility for the violation of delivery terms, if the goods are not delivered to the Buyer or are delivered late due to the fault of third parties or for reasons related to the actions or inaction of the Buye.
6.6. If the Buyer does not pick up the goods or fails to accept them and the Buyer has paid for the goods and their delivery, the Seller's representatives contact the Buyer regarding another time and/or method of delivery of the goods. If the Buyer still does not pick up the goods or fails to accept them, such goods are returned to the Seller, the order is cancelled, and the money paid for the goods is returned to the Buyer, after deducting the bank fees charged to the Seller for the bank transfers made and the goods delivery fee, if it was paid by the Buye.
6.7. In all cases, the Buyer must check the condition of the shipment and the product(s) during delivery and sign the shipment transfer - acceptance document. If the Buyer notices packaging damage, inconsistencies in the set (assortment), quantity of the delivered goods, he must indicate comments about these infringements in the shipment transfer - acceptance document or draw up a separate act on these infringements. The Buyer must do this in the presence of the courier. After the Buyer signs the shipment transfer - acceptance document, it is considered that the goods have been handed over in a suitable condition, without damage and there are no discrepancies in the product(s) package (such as can be determined during the external inspection of the goods).
6.8. The risk of accidental loss or damage of the goods passes to the Buyer from the moment the goods are transferred to the Buyer.
7. Quality of the goods.
7.1. All information about goods sold in the e-shop www.domusinn.com are indicated in the product description attached to each product.
7.2. The Seller is not responsible for the fact that in the e-shop the colour, shape or other parameters of the goods in the store may not correspond to the actual size, shape and/or colour of the goods due to the characteristics of the display used by the Buyer or other technical reasons. Product photos are for illustrative purposes only and are exemplary. Shades, inscriptions, parameters, dimensions, sizes, functions, and/or any other features of the original products may look different than in reality due to their visual characteristics, so please refer to the product features that are indicated in the product descriptions.
7.3. The goods are provided with a quality guarantee valid for a certain period of time, the specific term and other conditions are indicated in the descriptions of specific products or together with the invoice of the goods, which corresponds to the guarantee sheet.
7.4. The Seller does not provide warranty maintenance services for goods.
8. Return/exchange of goods.
8.1. The Buyer has the right to cancel the contract concluded with e-shop www.domusinn.com, no later than within 14 (fourteen) days from the day of delivery of the goods, informing the Seller by e-mail address specified in the "Contact Us" section of the e-shop, indicating the name of the returned product, the order number and the reasons for the return, also indicate the account for the refund. When returning the product, it is necessary to present the document of its purchase.
8.2. The Buyer can exercise the right provided in clause 8.1 of the Terms only if the product has not been damaged or its appearance has not changed, nor has it been used, and the original packaging of the product has not been damaged. Buyer pays all shipping costs if he wants to return quality product.
8.3. Only natural persons can return quality goods, the additional return guarantee does not apply to legal entities.
8.4. Defective goods are returned/exchanged within the warranty period. The Buyer must inform the Seller by e-mail specified in the "Contact Us" section of the e-shop, indicating the name of the product to be returned/exchanged, the order number, reasons for the return/exchange, evidence (photos, video material), also indicate the account for the refund. When returning the product, it is necessary to present the document of its purchase. The Buyer does not have the right to return the product if the defect of the product is small.
8.5. The Seller must return the money to the Buyer for the goods, to the Buyer's account no later than within 14 (fourteen) days from the day on which he received the Buyer's notice of contract cancellation. The Seller may not return the above mentioned money to the Buyer, until the goods are not returned to the Seller.
8.6. The specific product cannot be returned/exchanged if the Buyer's such right is not indicated in the applicable legislation.
8.7. When returning or exchanging goods, the costs of returning the goods shall be borne by the Buyer.
9. Responsibility.
9.1. The Buyer is responsible for illegal actions performed using the www.domusinn.com e-shop.
9.2. After registering at e-shop, the Buyer is responsible for protecting and/or transferring his login data to third parties. If the services provided by www.domusinn.com are used by a third person who has connected to www.domusinn.com using the Buyer's login data, the Seller considers this person to be the Buyer.
9.3. The Seller is released from any responsibility in cases where losses arise because the Buyer, ignoring the Seller's recommendations and the Buyer's obligations, did not familiarize himself with these Terms.
9.4. In the event of damage, the guilty Party compensates the other Party direct losses.
10. Marketing and information.
10.1. The Seller at his own discretion can initiate various promotions in the e-shop.
10.2. The Seller has the right unilaterally, without separate notice, to change the conditions of the promotions, as well as to cancel them. Any changes or cancellation of the conditions of the promotions are valid from the moment of its adaption.
10.3. The Seller sends all messages using the means of communication specified in the Buyer's registration form.
10.4. The Buyer sends all messages and questions related to the submission and execution of the order to the Seller's e-mail address specified in the "Contact Us" section of the e-shop.
11. Final provisions.
11.1. These Terms are drawn up in accordance with the legal acts of the Republic of Lithuania. Relations arising on the basis of these Terms shall be governed by the law of the Republic of Lithuania.
11.2. All disagreements arising from the implementation of these Terms shall be resolved through negotiations. If an agreement cannot be reached, disputes are resolved in the courts of the Republic of Lithuania, guided by the procedural and substantive law of the Republic of Lithuania.
11.3. In the event that the Buyer does not agree with the Seller's response to the Buyer's written claim, the Buyer (natural person, consumer) can submit his request/complaint regarding the goods purchased from the Seller on www.domusinn.com to the State Consumer Rights Protection Service (Vilniaus str. 25, 01402 Vilnius , e-mail: tarnyba@vvtat.lt, phone: 85 262 67 51, fax: (85) 279 1466, on the website www.vvtat.lt (also for the territorial units of the State Consumer Rights Protection Service in counties) - or fill out the application form on the EGS platform https://ec.europa.eu/odr.
